Terms of Use — Restaurant Rush
These Terms of Use (“Terms”) govern your use of Restaurant Rush: Cook & Serve (the “Game”) and restaurantrush.birkinapps.com, provided by Süleyman Gökhan Birkin, operating as Birkin Apps (“we”, “us”). By downloading or playing the Game you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Game.
1. Who can play
You must be old enough to agree to these Terms in your country, or have a parent or guardian agree for you. A parent or guardian is responsible for purchases made by a minor.
2. Your account
You can play as a guest; your progress is linked to a guest ID on your device. If you sign in with Apple, Google or email, you can recover your progress on other devices. Guest progress can be lost if you delete the Game or change device without signing in. Keep your sign-in details secure; you are responsible for activity under your account.
3. Licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Game for your own non-commercial entertainment on devices you own or control, in line with these Terms and the rules of the store you got it from.
4. Virtual currency and items
- The Game uses virtual currencies (“Dollars” and “Coins”) and virtual items such as upgrades, cosmetics and boosts. They have no monetary value, are not your property, cannot be exchanged for real money, goods or services, and cannot be sold or transferred outside the Game.
- What you receive is a limited licence to use them in the Game. We may change, rebalance or correct virtual currency and items, for example to fix errors or to remove amounts obtained through cheating or bugs.
- Unless the law requires otherwise, virtual currency and items are not refundable, including when your account is deleted or closed.
5. In-app purchases
- The Game is free to download. It offers optional in-app purchases: the Starter Bundle (a one-time purchase that also removes ads), coin packs and the Supporter Pack. There are no subscriptions.
- Payments are processed by Apple or Google under their terms, and prices are shown in your local currency before you confirm. Refunds are handled by Apple or Google under their refund policies. Purchases are made through the App Store or Google Play in-app purchase system and delivered in the Game once the store confirms them.
- The Starter Bundle and other purchases that remove ads or unlock permanent items can be restored with Restore Purchases in the premium shop, using the same store account. Coin packs and the Supporter Pack are consumable: they can be bought more than once, are used up when delivered and cannot be restored.
- If a purchase is not delivered, contact us with your store receipt and we will fix it or help you request a refund from the store.
6. Ads
The Game is supported by ads from Google AdMob, including optional rewarded ads that give an in-game bonus. Rewards are granted only when an ad is completed and depend on ad availability. See the Privacy Policy for your advertising choices.
7. Leaderboards, names and fair play
- Leaderboards show your nickname (or your restaurant name), scores, run details, chef level and chef look publicly, in the Game and on our website. Endless runs played at a slower accessible pace are ranked on separate Relaxed boards.
- Do not use names that are offensive, hateful or sexual, that impersonate others, that contain personal information, or that infringe someone else’s rights. We may rename, hide or remove names and entries that break these rules.
- Scores must come from normal play. We may remove scores, reset progress or restrict leaderboard access if we reasonably believe they were obtained by cheating, modified software, automation or exploiting bugs.
8. Acceptable use
You agree not to: cheat or use bots, mods or tools that give an unfair advantage; interfere with or overload our servers; reverse engineer, decompile or modify the Game except where the law allows it; access other players’ data; or use the Game to break any law or anyone’s rights.
9. Online features and changes
Cloud saves, leaderboards, events, daily rewards and other online features need an internet connection and may change, be paused or end. We may update the Game, rebalance gameplay, and change or remove content or features. We will try to give notice of major changes in the Game or on the store listing.
10. Intellectual property
The Game, including its name, characters, art, music, code and content, belongs to Birkin Apps or its licensors and is protected by law. Apart from the licence above, you receive no rights in it.
11. Third-party services
Some features use third-party services (Apple, Google). Their own terms and privacy policies also apply to your use of those services.
12. Disclaimer
To the extent the law allows, the Game is provided “as is” and “as available”, without warranties of any kind. We do not guarantee that it will be uninterrupted or error-free, or that progress will never be lost.
13. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, virtual items or profits. Our total liability is limited to the amount you paid for the Game and in-app purchases in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or your mandatory rights as a consumer.
14. Suspension and termination
You may stop using the Game at any time and, if you signed in, delete your account in Settings. We may suspend or end your access to online features if you seriously or repeatedly break these Terms.
15. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and may bring claims before your local courts.
16. Apple App Store
If you downloaded the Game from the Apple App Store, Apple’s Licensed Application End User License Agreement also applies. These Terms are between you and us, not Apple. Apple is not responsible for the Game or its content, has no obligation to provide maintenance or support for it, and is a third-party beneficiary of these Terms with the right to enforce them against you.
17. Changes to these Terms
We may update these Terms. We will post the new version here with a new date. If you keep playing after an update takes effect, the updated Terms apply.
